Terms of Service

By accessing or using Marcus Intelligence, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction), and that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

If you do not agree to these Terms, you must not access or use the Service.

Marcus Intelligence is an AI-powered test automation platform. The Service allows users to:

• Submit a website URL and/or a Business Requirements Document (BRD) for analysis.
• Receive AI-generated test cases based on that input.
• Execute those test cases in a real browser using automated Playwright browser automation.
• Review pass/fail results and analytics.

The Service is provided on an “as-is” basis. AI-generated test cases are suggestions only and may not be complete, accurate, or suitable for all purposes. The Service is not a replacement for professional quality assurance engineering.

Marcus Intelligence implements technical safeguards (SSRF protection, domain scoping) but these do not replace your obligation to obtain proper authorization. You are solely responsible for ensuring you have the right to test any target system.

Unauthorized testing is a material breach of these Terms and may result in immediate account termination and legal liability.

You agree not to use the Service to:

• Test websites, APIs, or systems you do not own or lack explicit permission to test.
• Conduct denial-of-service attacks or generate excessive automated traffic against any system.
• Circumvent security controls, rate limits, WAFs, CAPTCHAs, or access restrictions of any system.
• Scrape or extract proprietary data from third-party services in violation of their terms.
• Upload BRD documents containing personally identifiable information (PII), financial data, health data, or trade secrets.
• Share, sell, or transfer account credentials to third parties.
• Attempt to reverse-engineer, decompile, or extract the source code of the Service.
• Violate any applicable local, national, or international law or regulation.
• Use the Service for any purpose that could harm Marcus Intelligence, its users, or third parties.

We reserve the right to investigate and take appropriate action against any violation of this policy, including suspension or termination of your account.

Test cases generated by the Service are produced by large language models (OpenAI GPT models) and are suggestions only. They may be incomplete, incorrect, duplicative, or inappropriate for your specific use case.

Marcus Intelligence makes no representation or warranty that AI-generated test cases will:

• Cover all functionality of your application.
• Produce accurate pass/fail verdicts in all circumstances.
• Meet any specific quality, compliance, or regulatory standard.
• Be free from errors, hallucinations, or model limitations.

You are solely responsible for reviewing, validating, and acting upon AI-generated test cases and results. Do not rely solely on the Service as your quality assurance process for production systems, safety-critical applications, or regulated industries.

You are responsible for maintaining the confidentiality of your account credentials. You must not share your password or allow others to access your account. You are responsible for all activity that occurs under your account or organisation.

If you are the organisation administrator, you are responsible for all members you add to your organisation and their compliance with these Terms.

If you suspect unauthorized access to your account, notify us immediately at support@marcusai.in.

The Service is offered on Free, Standard, Team, and Enterprise tiers as described on the Pricing page.

• Billing currency: All paid plans are billed in Indian Rupees (INR) via Razorpay, regardless of the currency displayed for informational purposes.
• Auto-renewal: Paid subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
• Free trial: Standard and Team plans include a 7-day free trial. No credit card is required to start the trial. After 7 days, the plan continues at the applicable rate unless you cancel before the trial ends.
• Refunds: All fees are non-refundable except at our sole discretion or as required by applicable law. If you believe you were charged in error, contact support@marcusai.in within 7 days of the charge.
• Plan limits: Usage limits (test runs, team members, result history) are enforced per plan tier. Exceeding limits may result in service restrictions until the next billing period.
• Cancellation: You may cancel at any time from Settings → Billing. Access continues until the end of your current billing period. No prorated refunds are issued for partial periods.

All rights, title, and interest in and to the Service — including software, algorithms, models, branding, documentation, and user interface — remain the exclusive property of Marcus Intelligence and its licensors.

You retain full ownership of content you upload to the Service (BRD documents, URLs, instructions). By submitting content, you grant Marcus Intelligence a limited, non-exclusive, royalty-free licence to process, store, and transmit that content solely to provide the Service to you. This licence terminates when you delete the content or close your account.

You may not use Marcus Intelligence’s name, logo, or trademarks without prior written permission.

The Service depends on third-party platforms including OpenAI (AI generation), Supabase (database and authentication), Razorpay (payment processing), Sentry (error monitoring), and Vercel (hosting). Your use of the Service is also subject to the applicable terms and privacy policies of these providers.

Marcus Intelligence is not liable for any failure, outage, change in terms, or data handling by any third-party provider. We will make reasonable efforts to notify you of material changes to our sub-processors.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.

We do not warrant that the Service will be error-free, that defects will be corrected, or that results produced by the Service will be accurate or complete. No uptime guarantee is provided on the Free tier. Paid tiers are subject to any SLA separately agreed in writing.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MARCUS INTELLIGENCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR DAMAGE TO SYSTEMS — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL FEES YOU PAID TO US IN THE 12-MONTH PERIOD IMMEDIATELY PRECEDING THE CLAIM, OR (B) ₹500 (FIVE HUNDRED INDIAN RUPEES) FOR FREE TIER USERS.

You agree to indemnify, defend, and hold harmless Marcus Intelligence and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your breach of these Terms, including the Authorized Use Requirement or Acceptable Use Policy.
• Your unauthorized testing of any website or system.
• Any claim by a third party arising from content you submitted to the Service.
• Your violation of any applicable law or regulation.
• Any decisions or actions you took based on AI-generated test results.

We may suspend or permanently terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms or that your use poses a risk to the Service or other users. We will make reasonable efforts to notify you unless doing so would be prohibited by law or would compromise an investigation.

You may delete your account at any time from Settings → Account. Upon account deletion, your personal data and organisation data will be permanently removed in accordance with our Privacy Policy.

Clauses that by their nature should survive termination — including Sections 5, 8, 11, 12, and 14 — will survive termination of these Terms.

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles.

Before initiating any legal proceedings, you agree to first contact us at support@marcusai.in and attempt to resolve the dispute informally for a period of at least 30 days.

If the dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the competent courts located in India.

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
